FAQ #8: What are violations of the DeviantArt copyright policy?
FAQ 8 is probably one of the most important FAQs many groups deal with and encounter, sometimes without even knowing it. deviantART, while is loose on some aspects of copyright policy, is fairly strict with others. And sometimes, it depends on who you get at the help desk.
Let's Dissect #8
"a creative work protected under copyright ... without first getting the proper permission from the owner."
The first paragraph has these words. These are the most important words in that paragraph. In its most basic form, this says, "If it isn't yours, you can't use it." In the most complicated light, this says, "If it isn't yours, get permission from the owner before you use it." Despite how simple this seems, people mess it up all the time. Everyone thinks Fair Use and De Minimus are get-out-of-jail-free-cards. No. Everyone thinks credit makes it okay. No. Stick with the basics and you will be happy and the people around you will be happy.
"The most common ways this can happen is by simply posting the work to a deviantART gallery, adapting or copying the original work or by manipulating or altering the original."
Again, this all means that you can't repost it if it doesn't belong to you, you can't copy it if it doesn't belong to you, and you can't edit it if it doesn't belong to you.
When you see clear infringement of FAQ #8, it is best to report silently. When you see clear infringement of FAQ #8 and the $taff ignore it, dissect their FAQ in a nice and polite way, adding in why you think the piece in violation is truly in violation.
Patience can make huge changes.
Kindness can make more changes.
Logic pisses people off.

FAQ Recap: A gallery of infringement!
What do you do when you find a gallery of infringement or possible infringement?It is possible, if it is only about a dozen deviations, that you can report each one by itself. But some users have fifty, a hundred, or more deviations that are problematic. How do you deal with that? You can't report each individual deviations, and the Help Desk will not accept a gallery report, so what do you do?
The answer is very simple. See this.
Anytime you run into a full gallery of possible infringement, you need to report as many as you can, BUT you do not have to report the whole gallery. Simply add an additional comment that the rest of the gallery nee

This blog is incredibly informative, written in terms that everyone can understand, and gives a great straightforward explanation of why dA processes their copyright infringement claims in the way that they do.

You can submit infringement claims 4 different ways. Two ways are formal: through the help desk and through the email violations@deviantart.com. The formal methods are to be used only by the copyright holder and no one else.

We have chosen to talk about this today because traces are becoming more and more common. And while that is not okay, by law, deviantART can't do a whole lot unless the original artist reports it.
Why?
Many traces are legit and are for the pose or a specific feature. By law, these pieces have enough changed about them that they are to derivative works but new works attributed to the new artist. A pose, a skirt, hair, eyes, etc are not copyrightable.
